1. Introduction
These terms and conditions (hereinafter, "Terms") govern the use of the synchronization platform BackOffice - ImaginaITS (hereinafter, "the Platform"), owned by Imagina Informática Technology Solutions S.L. (hereinafter, "the Company"), which enables the synchronization of desktop applications, such as ImaCash, with the web to efficiently manage cash sales and other data in the cloud.
By using the Platform, you fully and unreservedly accept these Terms. If you do not agree with them, please do not use the Platform.
2. Description of the Service
The BackOffice - ImaginaITS Platform allows the synchronization of the Company’s desktop applications, such as ImaCash, with cloud services, enabling remote management of sales and other data related to commercial activity. The service is exclusively available to users whose product licenses from the Company (such as ImaCash) include an active Maintenance Service.
3. Use of Data
The Company may use data generated and synchronized through the Platform for the purpose of improving services, resolving errors, and optimizing the performance of both the Platform and the desktop applications covered under the umbrella of Imagina Informática Technology Solutions. This data may include, among other things, information on sales, application operations, and system performance.
4. User Rights over Data
Users of the Platform have the right to request the deletion of their personal data or their account at any time by sending a request to [email protected]. The Company is committed to deleting such data in compliance with the applicable data protection regulations, particularly the General Data Protection Regulation (GDPR) of the European Union and the Organic Law on Data Protection and Guarantee of Digital Rights (LOPDGDD) of Spain.
5. Disclaimer of Liability
The Company assumes no responsibility for the loss of data related to sales, operations, or any other information managed through the desktop application or the Platform. The use of the Platform is at the sole risk of the user. The Company will make every effort to maintain data integrity but does not guarantee that the service will be error-free, uninterrupted, or free from data loss.
6. Service Requirements
To use the BackOffice - ImaginaITS Platform, users must have an active license for the corresponding Company product and this license must include an active Maintenance Service. The Company reserves the right to suspend or deny access to the Platform if these requirements are not met.
7. Intellectual Property
All rights to the software, the Platform, its components, and any associated technical documentation are the exclusive property of Imagina Informática Technology Solutions S.L.. The use of the Platform does not, under any circumstances, imply the transfer of any intellectual or industrial property rights over it.
8. Modification of Terms and Conditions
The Company reserves the right to modify these Terms at any time and without prior notice to adapt them to future legislative changes or service improvements. Modifications will take effect from the moment they are published on the Company’s website or within the Platform itself.
9. Applicable Law and Jurisdiction
These Terms are governed by the current Spanish legislation. Any conflict that may arise between the parties regarding the interpretation, application, or enforcement of these Terms will be resolved by the courts of Madrid, unless otherwise dictated by consumer protection regulations.
